End-User Licence Agreement (EULA) & Visitor Terms

This document constitutes the legal agreement between SOGLAB LIMITED and any end-user (referred to as "Visitor", "User", "you", or "your") accessing COMENIUS WebXR augmented reality experiences and curated narrative journeys.

Please read this End-User License Agreement and Visitor Terms ("Agreement", "Terms") carefully before launching any WebXR-based augmented reality (AR) experience, scanning a COMENIUS QR code on-site, or interacting with our digital curation ecosystem (collectively, the "Services").

The Services are operated and hosted by SOGLAB LIMITED ("SOGLAB", "we", "us", or "our"), a company registered in England and Wales (Company Registration Number: [Insert Company Number]; Registered Office Address: [Insert Registered Office Address]), on behalf of our participating partner museums, galleries, and cultural heritage sites (each a "Host Institution").

By scanning a COMENIUS QR code, checking the "I Agree" box, or clicking "Launch Experience" (or any equivalent interface button) in your mobile browser, you are entering into a legally binding agreement with SOGLAB and agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not launch the WebXR experience and must close the browser tab immediately.

1. Scope of Service and "No-App" WebXR Delivery
  1. Frictionless Web-Based Delivery: COMENIUS is a spatial interface designed to run directly in your mobile web browser (e.g., Safari, Chrome, Edge) utilizing open WebXR standards. There is no native mobile application to download, install, or update from commercial app stores.

  2. Bring Your Own Device (BYOD): To experience the curated spatial content, you must use your own compatible mobile smartphone or tablet. You are solely responsible for acquiring, maintaining, and charging a compatible device, as well as paying any local mobile data or carrier connectivity charges incurred while streaming our immersive content.

2. Limited License Grant
  1. Grant of License: Subject to your ongoing compliance with these Terms, SOGLAB grants you a personal, revocable, non-exclusive, non-transferable, non-sublicensable, limited-scope license to access, view, stream, and interact with the digital AR overlays, 3D voxel models, graphics, and audio-guided narrations (collectively, the "Licensed Content") solely for your personal, non-commercial, educational, and recreational use on-site at the Host Institution.

  2. Ownership and Proprietary Rights: You acknowledge that all title, ownership, and intellectual property rights in the COMENIUS WebXR platform, the software architecture, the underlying code, and the Host Institution's curated Licensed Content (including historical descriptions and proprietary 3D reconstructions) remain exclusively with SOGLAB and/or the Host Institution. No title or property rights are transferred to you under this Agreement.

  3. Restrictions on Use: You agree that you shall not, and shall not permit any third party to:

    • Copy, record, scrape, download, republish, redistribute, modify, or create derivative works of any Licensed Content (including extracting raw 3D models or audio narration files) without explicit written authorization from SOGLAB and the Host Institution.

    • Attempt to reverse-engineer, decompile, de-obfuscate, or extract the source code of the underlying WebXR tracking engine or spatial user interface.

    • Circumvent or attempt to bypass any digital rights management (DRM), geolocation restrictions, or security controls embedded within the Services.

3. Special Technical Disclosure: Camera Access & Zero-Image-Transmission Pledge

Because COMENIUS transforms physical artifacts into interactive spatial interfaces, the WebXR engine must access your device's camera to align digital overlays with physical objects in real-time.

  1. Explicit Consent Required: Launching the AR experience will trigger a standard browser-level prompt requesting permission to access your device’s camera. If you deny this permission, you will not be able to experience the interactive AR overlays, though you may still access text-based or non-spatial audio narratives.

  2. Our Zero-Image-Transmission Pledge:

    • Local On-Device Processing: Camera feed frames are processed strictly locally, on-device in your browser's temporary cache using advanced Computer Vision for Simultaneous Localization and Mapping (SLAM) and visual tracking.

    • No Data Transmission: SOGLAB never records, streams, saves, transmits, or shares raw video footage, individual photos, spatial geometry, or environmental data to our cloud servers, the Host Institution's systems, or any third-party networks.

    • Immediate Discarding: Visual data is used purely for calculating spatial coordinate systems and is discarded instantly frame-by-frame. Closing the browser tab terminates camera access and purges all active visual processes immediately.

4. Visitor Physical Safety Disclaimer (CRITICAL SHIELD)

This section outlines your material waiver of liability. By accessing and using the Services within physical galleries, heritage sites, or public spaces, you agree to the following terms:

  1. Maintain Situational Awareness: The COMENIUS WebXR experiences overlay digital elements onto physical reality. This can distract your visual and auditory attention. You maintain sole and absolute responsibility for your own physical safety and the safety of those in your care (including minors) while using the Services.

  2. Rule of Movement (Stand Still): Do NOT walk, run, climb stairs, or navigate physical spaces while looking directly at your device screen or wearing auditory headphones. Always proceed as follows:

    • Identify a designated, safe, and clear on-site area near the physical artifact or QR marker.

    • Bring yourself to a complete, stable standstill before looking at your screen to launch or interact with the AR experience.

    • Look away from your screen and scan your physical surroundings before resuming movement or transitioning to the next display stop.

  3. Complete Release of Physical Liability: SOGLAB LIMITED, its directors, employees, affiliates, subcontractors, and the Host Institution shall under no circumstances be held legally or financially liable for any bodily injury, personal accident, slip, trip, fall, physical collision, property damage, death, or any other loss occurring on the Host Institution's premises while you are using, viewing, or interacting with COMENIUS AR experiences.

  4. Hardware Safeguards (BYOD Protection): You are using your own personal device in public, often crowded settings. SOGLAB and the Host Institution accept zero liability for any accidental damage to your personal property, including but not limited to dropping your smartphone, cracking screens, or device hardware/battery degradation occurring during or as a result of using the Services.

5. Compliance with Host Institution Rules
  1. Conduct and Etiquette: Your use of COMENIUS must comply with all standard visitor rules, safety guidelines, and code of conduct policies of the Host Institution.

  2. Auditory Courtesy: To preserve a peaceful and respectful atmosphere for other visitors, you are highly encouraged to use personal headphones or earbuds when listening to COMENIUS audio-guided narratives. If you do not have headphones, you must keep your device’s speaker volume at a low, non-disruptive level.

6. No Warranty and Platform Limitations
  1. "As-Is" Delivery: COMENIUS Services are provided to you on an "as-is" and "as-available" basis, without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

  2. Environmental Variables: You acknowledge that the quality and reliability of WebXR spatial tracking depend heavily on external environmental variables beyond SOGLAB's control. These include local lighting conditions, physical shadows, glass display reflections, cellular/Wi-Fi signal strength in historical stone buildings, and the raw hardware capabilities of your specific device. SOGLAB does not warrant that the Services will be uninterrupted, error-free, or continuously accessible.

7. Limitation of Liability

To the maximum extent permitted by applicable law (including the UK Consumer Rights Act 2015 and equivalent EU consumer protection laws), SOGLAB’s total aggregate liability for any direct claims, losses, or damages arising out of or in connection with your use of the WebXR services—whether in contract, tort, or otherwise—shall be strictly limited to the amount of £10.00.

8. Term and Termination

This Agreement remains in effect from the moment you launch the COMENIUS WebXR session until you terminate the session by closing the corresponding web browser tab. SOGLAB and the Host Institution reserve the absolute right to restrict, suspend, or terminate your access to the WebXR experience at any time, without prior notice, if they suspect a breach of these Terms or for general operational reasons.

9. Governing Law and Jurisdiction

This Agreement, its subject matter, and its formation (including any non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. Both parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute.
